He was arrested again six months later by the New York City Police Department for his role in the burglary and murder of Daniel Enchautegui, a 28-year-old police officer. Enchautegui met Brancato and his accomplice Steven Armento outside an empty house near his home after hearing a glass smash, according to sources. He was shot by the men while attempting to back up. He was subsequently brought to Jacobi Medical Center, where he was quickly pronounced dead.

Brancato and Armento were later apprehended with several gunshot wounds. Armento was revealed to be the father of Stefanie, his then-girlfriend. In October 2008, Armento was found guilty of first-degree murder and sentenced to life in prison without the possibility of release.
