He was also charged with a seventh-degree Class A misdemeanor after police discovered four bags of heroin in his cigarette box.

He was arrested again six months later by the New York City Police Department for his role in the burglary and murder of Daniel Enchautegui, a 28-year-old police officer. Enchautegui met Brancato and his accomplice Steven Armento outside an empty house near his home after hearing a glass smash, according to sources. He was shot by the men while attempting to back up. He was subsequently brought to Jacobi Medical Center, where he was quickly pronounced dead.

Brancato and Armento were later apprehended with several gunshot wounds. Armento was revealed to be the father of Stefanie, his then-girlfriend. In October 2008, Armento was found guilty of first-degree murder and sentenced to life in prison without the possibility of release. Brancato was charged with second-degree murder in the meanwhile, and his trial began in November 2008.

In January 2009, a jury judged him not guilty of the murder but convicted of first-degree attempted burglary and sentenced him to ten years in jail after many trials.

Brancato continued to use drugs while in prison, and he too died of a heroin overdose. He was freed from prison on parole on December 31, 2013.
